Add a checkbox for authors to give permission for DFO to share the publication on open repositories (including FOSR) but I think we don't have to specify where just a check box that says DFO can share (in accordance with open science). And if they say no, they can prompted with a text box to explain why. If they say that it is open, or will be open...we can ask for permission after the embargo date too*
Marie-Claire can provide text for the agreement

DFO has the right to share the publications (by default) unless the author requests otherwise and there is a clear reason not to. (In the policy Open science will be mandatory unless there is a good reason not to)
